Terms & Standard License

By purchasing, downloading, or using assets from Gelos Games, you agree to the following terms and conditions. These assets are provided under a non-exclusive, non-transferable, worldwide, and royalty-free license.

1. Grant of License (Allowed Usage)

You are granted a license to use the assets according to the following permitted uses:

• Unlimited Projects: You may use the assets in an unlimited number of commercial and non-commercial video game projects, experiences, and interactive media (including UEFN / Fortnite Creative maps).
• Modification: You may modify, alter, and adapt the assets to fit the specific aesthetic and technical needs of your projects.
• Marketing: You may use the assets in rendered promotional materials, trailers, and marketing campaigns related to your interactive projects.

2. Restrictions (Prohibited Usage)

To protect our creators and intellectual property, the following actions are strictly prohibited:

• No Resale or Redistribution: You may NOT redistribute, resell, sub-license, or share the source files of these assets, whether modified or in their original form.
• No Standalone Distribution: Assets must be embedded or packaged within a compiled game or interactive product. They cannot be distributed in a way that allows end-users to extract the raw asset files.
• No Open-Source Inclusion: You may NOT include these assets in open-source projects or public repositories (like GitHub) where the raw files can be freely downloaded by others.
• No AI Training: You may NOT use these assets, in whole or in part, to train, feed, or fine-tune artificial intelligence or machine learning models.
• No NFTs or Blockchain Minting: You may NOT mint the assets as standalone Non-Fungible Tokens (NFTs) or digital collectibles.
• No Malicious Content: You may NOT use the assets in projects that promote illegal activities, hate speech, or defamatory content.

3. Ownership

This license grants you the right to use the assets; it does not transfer ownership. Gelos Games (and its respective creators) retain all original copyrights, intellectual property rights, and title to the assets.

4. Liability

Assets are provided on an "as-is" basis. While we strive for the highest quality and compatibility, Gelos Games makes no warranties regarding the fitness of the assets for a particular purpose or future engine updates. Gelos Games shall not be held liable for any data loss, project corruption, or financial damages arising from the use or inability to use the assets.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer where digital content is faulty or not as described. Where liability cannot be excluded, our total liability to you in connection with a purchase is limited to the amount you paid for that purchase.

5. Accounts

• You must be at least 13 years old to create an account. If you are under 18, you confirm that a parent or legal guardian has agreed to these terms on your behalf.
• You may sign up with an email address and password or with a Google account. You are responsible for keeping your login details secure and for all activity on your account.
• One account per person. Accounts may not be shared, sold or transferred.
• You may optionally link a Discord account to unlock community features. You can unlink it at any time from your account page.
• We may suspend or close accounts that breach these terms, abuse promotions or referral rewards, initiate fraudulent payments or chargebacks, or attempt to redistribute purchased assets.

6. Purchases, Credits and Payment

• Prices are shown in US dollars. Where tax applies, it is shown before you confirm payment.
• Payments are processed by Stripe. We never see or store your full card details.
• Purchased assets are added to your account library and can be downloaded immediately and re-downloaded later while your account exists.
• Credits are a store credit bought in credit packs or earned through cashback, referrals, promotions, tips from other members and rewards for reviews of community snippets you shared. Credits have no cash value, cannot be withdrawn or exchanged for money, expire 12 months after they are added, and are forfeited when an account is closed.
• You may send credits to another member as a tip on their community snippet. Tips are final, except that tips on a snippet later removed for breaking these terms are returned to the sender. Credits cannot otherwise be transferred or sold.
• If a payment is refunded or reversed by your bank, the credits it bought and any credits earned from it (including credits already tipped to others) are removed, and any assets it bought are removed from your library. A balance may go below zero until new credits cover the difference.
• Rewards for snippet reviews are paid to the snippet's creator, never to the reviewer, after a waiting period and only for genuine reviews. We may withhold or reverse rewards and tips that appear to be manipulated.
• Promo codes and referral discounts are subject to the conditions shown when they are issued and may be withdrawn if misused.
• Membership discounts and free-access tiers apply only while the membership is active.

7. Membership and Subscriptions

• Memberships are billed in advance on a recurring basis and renew automatically until cancelled.
• You can cancel at any time from your account page. Cancellation takes effect at the end of the current billing period, and you keep the benefits until then. No partial refunds are given for the remaining period.
• Credits granted by a membership remain usable after cancellation while your account remains open.
• We will give at least 30 days notice by email before changing membership prices or materially reducing benefits. You may cancel before the change takes effect.
• UK and EU consumers have a 14-day right to cancel a new subscription. By starting the membership you request that it begins immediately; if you cancel within 14 days you may be charged proportionally for the period used.

8. Right to Cancel and Refunds

Under the UK Consumer Contracts Regulations 2013 and the EU Consumer Rights Directive, consumers normally have 14 days to cancel a purchase of digital content. This right is lost when the content is supplied before the 14 days end, provided you expressly agreed to immediate supply and acknowledged losing the right to cancel.

• Assets are supplied immediately after payment. Before you pay, you confirm at checkout that you request immediate access and understand that you lose your right to cancel once the purchase is complete.
• As a result, purchases of assets are final and non-refundable, regardless of whether you have downloaded the files, except as set out in the Digital Goods & Refund Policy above.
• Your statutory rights are not affected. If an asset is faulty, not as described, or not fit for purpose, you are entitled to a repair or replacement, or to a price reduction or refund where a fix is not possible. Contact Support first so we can provide a fix.
• Opening a payment dispute or chargeback for a purchase that is not faulty is a breach of these terms and may result in the closure of your account and the loss of access to your library.

9. Your Data

We collect and store the personal data needed to run your account, deliver purchases and provide support. Our Privacy Policy explains exactly what we store, why, who processes it, and how you can access, correct or delete it. You can request the deletion of your account and personal data at any time through our Support page.

10. Acceptable Use and Termination

• You may not attempt to access other users' accounts or purchases, interfere with the operation or security of the store, scrape the catalogue, or use automated tools to download assets.
• Reviews must relate to your own experience with the asset and must not contain abusive, misleading or promotional content. We may remove reviews that break these rules.
• We may suspend or terminate your access to the store if you breach these terms. Where reasonable, we will tell you why and give you a chance to respond. Licenses for assets you have lawfully purchased continue after termination, but access to re-downloads may end.
• You may close your account at any time by contacting Support.

11. Intellectual Property Complaints

All assets, artwork, code and text on the store belong to Gelos Games or its licensors. If you believe content on the store infringes your rights, contact us through the Support page with a description of the work, the URL of the listing, and your contact details. We review every notice and remove infringing content where appropriate.

12. Changes to These Terms

We may update these terms from time to time. The date at the top shows when they were last changed. For material changes we will notify registered users by email or by a notice on the store at least 14 days before the change applies. Continued use of the store after that date means you accept the updated terms. Changes do not affect purchases already made.

13. Governing Law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you are a consumer living in the European Union, you also benefit from any mandatory protections of the law of your country of residence and may bring a claim in your local courts. Nothing in these terms affects those rights.
